In the Verkhovna Rada (Parliament) of Ukraine it was submitted a Bill (draft legislation) N. 6299 of  April 13 , 2010 as to making changes to some laws relative to imposing a ban on activity of extrasensory individuals, witch- doctors, fortune-teller s,   palmists astrologers and providing future (fortune)  predicting services [ http://gska2.rada.gov.ua:7777/pls/zweb_n/webproc4_1?id=&pf3511=37447 ].

On amending of some legislative acts (as to prohibition of activity of extrasensory individuals, sorcerers, fortune-tellers, chiromancers and future (fortune) predicting services))

1. In the law on protection of social moral (N 1296-IV of November 20, 2003) it is proposed:

1)   to replenish article 1 {Comment: definition of terms, including pornography }, after indentation 12, with the following indentations:

fortune- telling – techniques, ceremonies, other means which allegedly allow to guess the fortune, foretell the future (fortune) or unknown facts about a person, group of persons, or some object (human being, movables   or real estate), as well as propose correction of the future (fortune) of a human being, solving her/his problems with the use of magic techniques and ceremonies;

palmistry, chirology – telling the future (fortune) or unknown facts about a person by the form of hand, palm, form of fingers, signs and lines on the hand;

numerology – defining the fortune or future of a person through studying numbers and dates;

future (fortune)  predicting services   – is the activity of fortune-teller s, chiromancers, astrologers {emphasize added}, seers,   sorcerer s,  clairvoyants , soothsayers, prophets and other persons who, with the use of fortune- telling, palmistry, numerology and magic ceremonies and techniques try to guess the future (fortune) or unknown facts about persons, objects or other phenomena (weather, harvest, etc.), as well as allegedly correct the future (fortune) of a person and his/her problems, kill the hoodoo with the use of magic techniques and ceremonies.

2) to replenish article 5, indentation 4, after the words:

“banning in electronic and other mass media  the cult of coercion, cruelty, distribution of pornography;”

with the following information:

“activity of extrasensory individuals,   sorcerer s,   fortune-teller s, chiromancers, services  with  telling of the future (fortune) ”

2 . In the Codex of Ukraine on administrative violation of the law (80731-10,  80732-10) (Bulletin of the Verkhovna Rada of Ukrainian SSR 1984, supplement N.51, article 1122):

Change article 181 as follows:

1) The title of the article 181 replace by the following: Gambling games in public places, activity of extrasensory individuals,     sorcerer s,    fortune-teller s,   chiromancers and providing future (fortune) predicting  services.

2) part 3 of article 181 present in the following edition:

Activity of extrasensory individuals,  sorcerer s, fortune-teller s,  chiromancers,  providing future (fortune) predicting services, spreading of information, distribution of materials, conducting mass meetings with participation of extrasensory individuals, sorcerer s,  fortune-teller s,  chiromancers and   actions   with providing future (fortune) predicting services.

causes amercement from 100 to 150 untaxed minimums of income.

Repeated breach of part 3 of this article

causes amercement from 150 to 300 untaxed minimums of income.

3. In the Law of Ukraine on advertising (Bulletin of Verkhovna Rada of Ukraine, 1996, N.39, article 181) of July 1, 2009

1) Article 8, part 1 { Quote: “On advertising it is prohibited :…”} complement with the following indentation:

“to advertise services and activity of extrasensory individuals,  sorcerer s,     fortune-teller s,  chiromancers, and future (fortune) predicting services , including the films, TV programs, mass meetings and individual consultations with a participation of extrasensory individuals, sorcerer s,   fortune-teller s,  chiromancers, as well as future (fortune) predicting services . ”

4. In the Law of Ukraine on the printing mass media (the press) in Ukraine N. 2782-12 of  June 9, 2004 :

1) In article 3, after indentation 4 { Quote: “the printing mass media (the press) in Ukraine may not be used for :” }, to add the following indentation:

“propaganda {popularization} of activity  of extrasensory individuals,   sorcerer s,    fortune-teller s, chiromancers, future (fortune) predicting services;”

5. In the Law of Ukraine “On television   and radio broadcasting” N. 3759-12 of  September 15, 2009 :

1) In Article 6, part 2{Quote: “ It is not allowed to use television and radio broadcasting organization for :” }, present indentations 7 and 8 after indentation 6, as follows:

broadcasting of programs and video plots from them where such persons participate as extrasensory individuals,  sorcerer s,   fortune-tellers, chiromancers, or where services are demonstrated pertaining to telling the future (fortune), except {emphasize added} of those documentary films that narrate about negative impact of extrasensory individuals,  sorcerer s,   fortune-tellers, chiromancers and future (fortune) predicting services;

broadcasting of documentary and feature {art} programs and telecasts, or video plots from them where extrasensory individuals, fortune-tellers, chiromancers demonstrate their activity or professional skills, techniques, ceremonies and future (fortune) predicting services, provide consultations, give advices .”

6. Final regulations .

            1. This Bill comes into force from the day of publication.

            2. The Cabinet of Ministers, in a two month period from the day of publication, have to:

– bring its statutory acts to conformity with this Law;

– exclude from the State Classifier of professions DK 003-95 of Ukraine the following professions:

5151 – Astrologer ; 5152 –  F ortune-teller ; 5152 – Chiromancer ;

       – provide brining the statutory acts of other ministries and central and regional executive bodies to conformity with this Law.
